4 ALLGEMEINSE GESCHÄFTBEDINGUNGEN - AGB (SPANISCHES RECHT)

1. Vertragsabschluss

  • Der Vertrag über Sitzungen, Workshops oder Seminare kommt zustande, sobald wir deine Anmeldung per E-Mail oder Nachricht (zum Beispiel WhatsApp, Telegram, Instagram Messenger, Facebook Messenger etc.) bestätigen. Ab diesem Zeitpunkt gelten diese AGB.

​

2. Widerrufsrecht

  • Für Dienstleistungen, deren Termin oder Durchführung in der Zukunft liegt, steht dem Kunden ein gesetzliches Widerrufsrecht von 14 Tagen ab Buchungsdatum zu. Innerhalb dieser Frist kann der Vertrag ohne Angabe von Gründen widerrufen werden.

  • Für Dienstleistungen, die sofort nach der Buchung beginnen und bei denen der Kunde ausdrücklich zustimmt, dass die Leistung sofort startet, besteht kein Widerrufsrecht.

  • Widerrufe sind per E-Mail an lenavoigt@outlook.com zu richten.

 

3. Preise und Zahlung

  • Alle Leistungen sind vorab zu bezahlen.

  • Zusätzliche Zeit wird in 15-Minuten-Schritten nachträglich abgerechnet.

  • Pakete (z. B. Remote Sessions oder Zoom Sessions) gelten für die dort angegebene Laufzeit.

 

4. Stornierung Sitzungen  (online oder vor Ort)

  • Absagen müssen spätestens 48 Stunden vor Beginn erfolgen.

  • Bei späterer Absage oder Nichterscheinen wird die Gebühr vollständig fällig.

  • Innerhalb der 48-Stunden-Frist kann der Termin innerhalb von einem Monat nachgeholt werden, ansonsten verfällt er ohne Erstattung.

 

5. Stornierung Seminare / Workshops (online oder vor Ort)

  • Anmeldungen sind verbindlich.

  • Bei Stornierung oder Nichterscheinen erfolgt keine Rückerstattung.

  • Wird die Veranstaltung von unserer Seite abgesagt, erfolgt vollständige Erstattung der gezahlten Seminargebühr. Reise- oder Unterkunftskosten werden nicht erstattet.

 

6. Remote Sessions

  • Inhalte der Sessions, einschließlich Chatnachrichten oder Aufzeichnungen, sind ausschließlich für den persönlichen Gebrauch bestimmt.

  • Jede Weitergabe oder Veröffentlichung ist ohne schriftliche Zustimmung untersagt.

  • Für die Remote Session muss die kurze Information von dir (Text oder Sprachnachricht auf dem vereinbarten Kanal) am Vortag der Session eingehen.

7. Gruppenchat (Telegram)

  • Alle Inhalte und Medien, die in diesem Chat geteilt werden, sind vertraulich und dürfen weder ohne schriftliche Zustimmung von Lena Voigt noch ohne die ausdrückliche Zustimmung der betroffenen Teilnehmenden weitergegeben, veröffentlicht oder anderweitig genutzt werden.

  • Möchte ein Teilnehmer Inhalte weitergeben oder veröffentlichen, muss Lena Voigt schriftlich informiert werden und ihre ausdrückliche Zustimmung erteilen.

 

8. Haftung

  • Sitzungen dienen der persönlichen Weiterentwicklung und Aktivierung eigener Ressourcen.

  • Sie ersetzen keine medizinische oder therapeutische Behandlung.

9. Geltendes Recht, Gerichtsstand und internationale Kunden​

  • Für alle Verträge, Buchungen und Dienstleistungen gilt ausschließlich spanisches Recht.

  • Für alle Streitigkeiten aus oder im Zusammenhang mit diesen Verträgen sind ausschließlich die zuständigen Gerichte in Spanien zuständig.

  • Kunden außerhalb der EU/EEA und des Vereinigten Königreichs erkennen an, dass die Berufshaftpflichtversicherung in diesen Ländern möglicherweise keine Deckung bietet.

  • Dennoch gilt für alle Verträge spanisches Recht, und die Gerichte Spaniens sind zuständig.

 

10. Sprache

  • Die Vertragssprache ist Deutsch, Englisch und Spanisch.

  • Im Falle von Unklarheiten oder Übersetzungsdifferenzen gilt die spanische Fassung als maßgeblich.​

1. Contract conclusion
The contract for sessions, workshops, or seminars is concluded as soon as we confirm your registration via e-mail or message (e.g., WhatsApp, Telegram, Instagram Messenger, Facebook Messenger). From this moment, these terms and conditions apply.

2. Right of withdrawal
For services whose date or performance is scheduled in the future, the customer has a statutory 14-day right of withdrawal from the date of booking. The contract may be cancelled within this period without giving reasons.
For services that begin immediately after booking and for which the customer expressly agrees that the service starts immediately, no right of withdrawal exists.
Cancellations must be sent by e-mail to lenavoigt@outlook.com.

3. Prices and payment

  • All services must be paid in advance.

  • Additional time is billed in 15-minute increments.

  • Packages (e.g., Remote Sessions or Zoom Sessions) are valid for the period specified.

 

4. Cancellation of sessions (online or in-person)

  • Cancellations must be made at least 48 hours before the appointment.

  • For later cancellations or no-shows, the fee is fully due.

  • Within the 48-hour period, the appointment can be rescheduled within one month; otherwise, it expires without refund.

 

5. Cancellation of seminars / workshops (online or in-person)

  • Registrations are binding.

  • No refund is given for cancellations or no-shows.

  • If the event is cancelled by us, the paid seminar fee will be fully refunded. Travel or accommodation costs are not covered.

 

6. Remote sessions

  • Session content, including chat messages or recordings, is for personal use only.

  • Any sharing or publication without written consent is prohibited.

  • For the remote session, your short message (text or voice) must be sent via the agreed channel on the day before the session.

 

7. Group chat (Telegram)

  • All content and media shared in this chat are confidential and may not be shared, published, or otherwise used without the written consent of Lena Voigt and the explicit consent of the participants.

  • If a participant wishes to share or publish content, Lena Voigt must be informed in writing and give explicit approval.

 

8. Liability

  • Sessions are intended for personal development and activation of resources.

  • They do not replace medical or therapeutic treatment.

  • The service provider holds a professional liability insurance policy covering all offered services for clients within the European Union (EU/EEA) and the United Kingdom (UK).

 

9. Governing Law, Jurisdiction and International Clients

  • All contracts, bookings, and services are governed exclusively by Spanish law.

  • For all disputes arising from or in connection with these contracts, the competent courts in Spain shall have exclusive jurisdiction.

  • Clients outside the EU/EEA and the United Kingdom acknowledge that professional liability insurance may not provide coverage in their country.

  • Nevertheless, Spanish law applies to all contracts, and the courts of Spain are competent.

10. LanguageThe contract language is German, English, and Spanish.

  • In case of any ambiguity or translation differences, the Spanish version shall be decisive.

4. TÉRMINOS Y CONDICIONES (LEY ESPAÑOLA)

1. Celebración del contrato

  • El contrato de sesiones, talleres o seminarios se formaliza cuando confirmamos tu inscripción por correo electrónico o mensaje (p. ej., WhatsApp, Telegram, Instagram Messenger, Facebook Messenger). A partir de ese momento, se aplican estos Términos y Condiciones.

2. Derecho de desistimiento

  • Para servicios cuya fecha o ejecución sea futura, el cliente dispone del derecho legal de desistimiento de 14 días desde la fecha de reserva. El contrato puede cancelarse sin justificación dentro de este plazo.

  • Para servicios que comienzan inmediatamente tras la reserva y con el consentimiento expreso del cliente, no existe derecho de desistimiento.

  • Las cancelaciones deben enviarse por correo a lenavoigt@outlook.com.

3. Precios y pago

  • Todos los servicios deben abonarse por adelantado.

  • El tiempo adicional se facturará en incrementos de 15 minutos.

  • Los paquetes (p. ej., Remote Sessions o Zoom Sessions) son válidos durante el período indicado.

4. Cancelación de sesiones (online o presenciales)

  • Las cancelaciones deben realizarse al menos 48 horas antes del inicio.

  • En caso de cancelación tardía o inasistencia, se cobrará la tarifa completa.

  • Dentro del período de 48 horas, la cita puede reprogramarse dentro de un mes; de lo contrario, caduca sin reembolso.

5. Cancelación de seminarios / talleres (online o presenciales)

  • Las inscripciones son vinculantes.

  • No hay reembolso por cancelaciones o inasistencias.

  • Si el evento es cancelado por nuestra parte, se reembolsará completamente la tarifa del seminario. No se cubren gastos de viaje o alojamiento.

6. Remote Sessions

  • El contenido de las sesiones, incluidos mensajes de chat o grabaciones, es solo para uso personal.

  • Está prohibida la difusión o publicación sin consentimiento por escrito.

  • Para la sesión remota, tu mensaje breve (texto o voz) debe enviarse por el canal acordado el día anterior.

 

7. Chat grupal (Telegram)

  • Todos los contenidos y medios compartidos en este chat son confidenciales y no pueden compartirse, publicarse o utilizarse sin el consentimiento escrito de Lena Voigt y el consentimiento explícito de los participantes.

  • Si un participante desea compartir o publicar contenido, Lena Voigt debe ser informada por escrito y dar aprobación explícita.

8. Responsabilidad

  • Las sesiones tienen como objetivo el desarrollo personal y la activación de recursos.

  • No sustituyen tratamientos médicos o terapéuticos.

  • No se ofrecen garantías de curación. 

  • Aviso sobre el uso de términos como “sanación”, “Healing” o “Sanación”:
    Todos los términos y prácticas utilizados en nuestras sesiones, talleres o sesiones remotas, como “sanación”, “Healing”, “Sanación”, “Sanador” o “Healer”, o expresiones similares, se refieren exclusivamente al desarrollo espiritual y personal en el marco de la técnica ThetaHealing®. No constituyen ninguna promesa de curación médica, terapéutica o psicológica.

  • La prestadora de servicios cuenta con un seguro de responsabilidad profesional que cubre todos los servicios ofrecidos a clientes en la Unión Europea (UE/EEE) y el Reino Unido (UK).

9. Ley aplicable, jurisdicción y clientes internacionales

  • Todos los contratos, reservas y servicios se rigen exclusivamente por la ley española.

  • Para cualquier disputa derivada o relacionada con estos contratos, solo son competentes los tribunales españoles.

  • Los clientes fuera de la UE/EEE y Reino Unido reconocen que el seguro de responsabilidad profesional podría no ofrecer cobertura en sus países.

  • No obstante, todos los contratos se rigen por la ley española y los tribunales españoles son competentes.

10. Idioma

  • El idioma del contrato es alemán, inglés y español.

  • En caso de dudas o diferencias de traducción, prevalece la versión en español.
